Introduction
iHostio agrees to provide services to subscribers (you) subject to the following Terms and Conditions. Use of the iHostio service constitutes acceptance of these Terms and Conditions.
iHostio reserves the right to modify these Terms and Conditions at any time.
No-Nonsense Uptime Commitment
Where other hosting providers guarantee 99.9% uptime, iHostio believes that standard is not enough. 0.1% downtime equals about 525 minutes per year, which is almost 9 hours of downtime.
We believe no downtime is acceptable, although downtime can occur because of hardware failure, network congestion, or human error.
Our commitment is to do our best to provide 0% downtime within our sphere of control, including our hardware and network infrastructure.
We will do our best to inform you as soon as we are aware of a problem and to give timely notice for any planned downtime.
If you have unplanned downtime for a server in a given month, you can request a free month for that server.
You may proactively design your infrastructure with fallback servers if downtime is critical to your business.
How We Handle Downtime
In the rare event of catastrophic hardware failure, an on-site engineer is typically alerted within 5 to 10 minutes. The server will be flagged as down in your iHostio control panel and a notification email will be sent.
The engineer will replace the failed hardware or install a replacement server, usually within 10 to 45 minutes depending on complexity.
If the failure involves a primary hard drive, our software team will restore the server from the most recent backup, which will be at most 24 hours old. This process normally takes 60 minutes or less.
When the server is restored, you will receive another notification email.
Affected servers may be made free for that month upon request.
Network downtime is more common than catastrophic hardware failure and may be caused by data center configuration issues, hardware issues, or third-party failures outside our control. In those cases, affected servers will also be flagged as down and users will be notified by email.
Freeloader Protection
iHostio no longer offers 3 months free for newly provisioned servers due to abuse of that feature.
This policy may still be available for eligible business users or high-volume accounts. Contact iHostio support if you are interested in free development servers for qualified use cases.
Account Creation
Creating multiple accounts to bypass quota limits or obtain discounted pricing is not allowed.
If you have a legitimate use case that requires separate accounts, contact us for confirmation before proceeding.
Prohibited Use
iHostio is designed for hosting websites and legitimate web applications. The following may result in immediate termination of your account without refund, and may also lead to fees or civil remedies where applicable.
We may allow you to retrieve your data after a ban if you request it, but access may be denied depending on the nature of the offense, especially where law enforcement is involved and the data may constitute evidence.
- Intentional misuse of resources including CPU cycles, memory, network bandwidth, and disk I/O
- Cryptocurrency mining
- Crypto, blockchain, and testnet workloads
- Running neural networks or neural network training
- Running stress-test tools
- Network scanning of any kind
- Tor relay nodes
- Torrent seeding or downloading
- Media streaming in certain configurations, especially copyrighted material
- Scrapers that continuously scrape third-party websites and create sustained high load
- Scrapers that collect copyrighted material
- Disseminating copyrighted material
- Traffic exchanges because they create little value and can have a disproportionate global resource impact
- Other sustained heavy-load activities that are unproductive or not business-critical
This does not include legitimate website hosting, ingestion or synchronization of data feeds, API interactions, and maintenance or cron jobs. If we detect high usage, we may first ask what is happening and may recommend upgrading your iHostio server if the workload is legitimate.
Spam, Hacking, and Unlawful Activity
iHostio has zero tolerance for spam and unsolicited bulk email. This includes junk mail, forged headers, compromised relays, false contact information, and mass mailings that implicate iHostio whether or not the messages originate from our network.
Attempting unauthorized or illegal access to computers, networks, or accounts is prohibited, as is any act interfering with another user or network or circumventing security measures.
Our services may only be used for lawful purposes. Transmission, distribution, or storage of data in violation of EU law, common law, copyright, trademark, trade secret, or other intellectual property rights is prohibited.
Harmful content or content portraying illegal acts, including terrorism, violent crime, or similar material, is prohibited.
Do not engage in illegal activities or activities harmful to iHostio or our customers.
Providing false data on any contract or application, including fraudulent use of credit card numbers, is prohibited.
Monitoring and Abuse Complaints
We do not routinely monitor or spy on our customers. However, immediately after signup we may keep a closer eye on activity to ensure services are not being used in breach of these Terms and Conditions.
Once we are satisfied that your usage is compliant, we reduce such monitoring and react only if your server later exhibits unusual behavior.
Any usage that leads to abuse complaints involving EU or international copyright violations must be discontinued promptly to avoid cancellation.
If you are in breach of these Terms and Conditions, we may treat any bandwidth consumed in your account as overage chargeable at our standard overage rates.
Support Boundaries
iHostio provides technical support through our support ticket system and may provide limited phone support during designated times.
Support covers your iHostio virtual server physically functioning. We do not provide technical support for application-specific issues such as CGI programming, custom web or mail server configuration, or other third-party application issues beyond our base supported stacks.
We do not provide support directly to your customers.
KVM Instances and Agent Requirement
To use certain services, you may be required to keep the relevant instance agent software running in any KVM VPS instance you have with us.
If you remove or disable required agent software, substantial functionality in iHostio may stop working and we may be unable to provide support.
Failure to reactivate required agent software may lead to server deletion or account suspension.
Invoicing and Payment
You agree that iHostio may charge your payment method monthly, annually, or on another billing interval agreed in advance. Payment is due upon invoicing.
Service may be interrupted on accounts that are 10 days past due. Accounts that remain uncollectable may be turned over to an outside collection agency.
iHostio may prospectively change rates and charges from time to time. We do not intend to adjust pricing unless necessary, such as due to new taxes, significant inflation, or materially increased operating costs.
iHostio is not responsible for bank fees, interest charges, overdraft charges, currency exchange charges, or similar fees resulting from charges billed by iHostio.
Refunds are issued if the customer no longer retains any active service and specifically requests a refund through our contact process.
Use of Services
You may use our services only if you are of legal age to form a binding contract and are not barred from receiving such services under applicable law.
You must provide current and accurate identification, contact, and other information during registration.
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You are solely responsible for all content within your account and must notify iHostio immediately of any unauthorized use or security breach.
iHostio is not liable for loss or damage resulting from inaccurate information or failure to keep your account secure.
Acceptable Conduct
You are responsible for the actions of all users of your account and for any data created, stored, displayed, or transmitted through your account while using iHostio.
You will not engage in any activity that interferes with or disrupts iHostio services or networks connected to iHostio.
Account Cancellation or Suspension
iHostio reserves the right to suspend network access to any customer if, in the judgment of our administrators, the customer’s server is the source or target of a violation of these Terms and Conditions or for any other reason iHostio chooses.
We will use reasonable care in notifying the customer and resolving the problem in a way that minimizes service interference.
We reserve the right to terminate service without notice for continued or repeated violations.
If inappropriate activity is detected, all accounts of the customer may be deactivated until an investigation is complete. Prior notification is not assured. In extreme cases, law enforcement may be contacted.
The customer will not be credited for the time machines were suspended.
If it becomes necessary for iHostio to cancel service without cause, we will provide 30 days’ advance notice.
You may cancel service at any time using the account deletion functionality in the iHostio web interface, subject to any outstanding charges and deletion requirements for active servers or products.
Cancellation does not relieve you of responsibility for payment of all accrued charges.
Where applicable, unused time on deleted servers or products may be refunded to the original payment method. Refunds may in some cases be reduced by payment processor transaction fees.
Service Credits
If you paid for services using iHostio service credits, any refund will be returned to your service credit balance.
Because service credits may be acquired through methods such as PayPal, coupons, or promotions, service credits are not refunded as cash to another financial instrument.
If you subsequently delete your account, applicable privacy rules may require deletion of all information associated with you, which may result in forfeiture of remaining service credits.
Missed Payments
If payment is severely overdue, your servers may be flagged for deletion.
iHostio does not allow an automated system to automatically delete servers. Accounts are reviewed by a human who considers your history and track record.
We will make best efforts to contact you directly and avoid deleting your server by accident.
Network and IP Addresses
iHostio assigns customers Internet Protocol addresses for use with the services. The right to use any assigned IP address belongs solely to iHostio, and the customer has no right to use the address except as permitted by iHostio during the term of this agreement.
Our allocation of IP addresses is subject to applicable regional registry policies, including name-based hosting expectations where supported by the protocol. You must use name-based hosting where possible.
Coupons and Promotions
Coupons are valid for a limited time only. iHostio reserves the right to modify or cancel coupons at any time.
If you do not purchase the qualifying items added to your cart while the coupon is active, the discount will not apply.
Coupons apply only to qualifying items showing the relevant offer on the order summary page and are not valid until properly applied.
Promotions are limited to one coupon per customer unless otherwise stated.
If you return items purchased with a coupon, the coupon discount or value may be deducted from the return credit.
iHostio has no obligation to pay taxes associated with coupon distribution or use. Customers are responsible for any applicable taxes.
Coupons are void where restricted or prohibited by law.
Limitation of Liability
You acknowledge that hosting services may be interrupted for reasons beyond the direct and exclusive control of iHostio and that damages from interruption may be difficult to determine.
Accordingly, iHostio is not liable for damages arising from such causes beyond our direct and exclusive control.
For claims based on iHostio’s own negligence, our liability will not exceed an amount equivalent to charges payable by the subscriber for services during the period in which the damages occurred.
In no event shall iHostio be liable for special or consequential damages, business loss, personal injury, or similar claims.
iHostio does not make implied or written warranties for any services and disclaims warranties of merchantability or fitness for a particular purpose.
This includes loss of data resulting from delays, non-deliveries, incorrect delivery, or service interruptions.
Disclosure to Law Enforcement
These Terms and Conditions prohibit use of our service for illegal activities. You therefore agree that iHostio may disclose subscriber information, including assigned IP numbers, account history, and account use, to a court or authority presenting a valid legal order, without further consent or notification where permitted by law.
In addition, iHostio may terminate services under this agreement where appropriate.
Warranty Disclaimer
You agree that your use of iHostio is at your sole risk. All services are provided on an as-is basis, without warranty.
Indemnity
By agreeing to these Terms and Conditions, you agree to indemnify iHostio for any violation that results in loss to iHostio or any claim brought against iHostio by a third party.
If iHostio is sued because of activity by you or a user acting through your account, you agree to pay damages awarded against iHostio, plus costs and reasonable legal fees.
Notice
You agree that iHostio may provide notices, including notices of changes to these Terms and Conditions, by email, regular mail, or postings on iHostio services.
Entire Agreement
These Terms and Conditions, together with any policies, guidelines, or amendments presented from time to time, constitute the entire agreement between you and iHostio and supersede any prior agreements relating to use of iHostio services.
Choice of Law and Forum
These Terms and Conditions and the relationship between you and iHostio shall be governed by applicable law as specified by iHostio from time to time, without regard to conflict of law provisions.
You and iHostio agree to submit to the personal and exclusive jurisdiction of the competent courts identified by applicable law and our operating jurisdiction.
Waiver and Severability
Failure by iHostio to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of that right or provision.
If any provision is found invalid by a court of competent jurisdiction, the parties agree that the court should endeavor to give effect to the original intent, and the remaining provisions will remain in full force and effect.
Statute of Limitations
You agree that any claim or cause of action arising out of or related to use of iHostio services or these Terms and Conditions must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.
